By accessing or using the Gemini Presale website and services, you agree to be bound by these Terms of Service. If you do not agree, you must not use the platform. These terms are intended for US residents only.

You must be at least 18 years old and a legal resident of the United States to use the platform. You must have the legal capacity to enter into binding contracts. By registering, you represent and warrant that you meet these requirements and are not located in a jurisdiction where token sales are prohibited.

You must create an account to participate in the presale. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate and complete information and to keep it updated.

You may not use the platform for unlawful purposes, attempt to circumvent security measures, submit false information, manipulate the presale process, or interfere with other users’ accounts. We reserve the right to suspend or terminate accounts that violate these rules.

All presale purchases are denominated in USD and settled in Bitcoin. Purchases are pending until confirmed by an administrator after verifying the on-chain Bitcoin transaction. Token allocations are not final until confirmed and are subject to the Token Sale Agreement.

All content, branding, code, and materials on the platform are owned by Gemini Presale or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the platform without our written permission.

The platform is provided on an “as is” and “as available” basis. We make no warranties regarding uninterrupted access, error-free operation, or specific investment outcomes. Cryptocurrency investments carry significant risk. You acknowledge that you are solely responsible for your decisions.

To the fullest extent permitted by law, Gemini Presale and its affiliates will not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the platform or participation in the presale, even if advised of the possibility of such damages.

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these terms will be resolved in the state or federal courts located in Delaware.

We may modify these terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms. Material changes will be communicated via email or a prominent notice on the site.
